These Terms & Conditions govern your use of the Moorelight Studios website and your purchase or acquisition of products, artwork, books, services, or other offerings from Moorelight Studios, LLC.
By accessing this website, placing an order, submitting an inquiry, or purchasing from Moorelight Studios, you agree to these Terms & Conditions, together with any policies referenced below.
About Moorelight Studios
Moorelight Studios, LLC is a Montana limited liability company and creative studio whose work includes fine-art photography, literature, publishing, experiences, licensing, and other creative and intellectual-property projects.
Convergence Fine Art is the fine-art photography division of Moorelight Studios.
References in these Terms to “Moorelight Studios,” “we,” “us,” or “our” include Moorelight Studios, LLC and its applicable divisions, brands, and authorized production or fulfillment partners.
Use of This Website
You may use this website for lawful personal and commercial inquiry purposes, including viewing artwork and editorial content, learning about Moorelight Studios, purchasing available products, and contacting the studio.
You may not use this website in a manner that interferes with its operation, attempts unauthorized access, infringes intellectual-property rights, facilitates fraud, or violates applicable law.
We may modify, suspend, restrict, or discontinue portions of the website or its offerings at any time.
Intellectual Property
Unless otherwise stated, all photographs, artwork, written material, essays, books, designs, logos, graphics, branding, product descriptions, page layouts, and other original content appearing on this website are owned by or licensed to Moorelight Studios, LLC and are protected by applicable copyright, trademark, and other intellectual-property laws.
Purchase or acquisition of a physical artwork, book, print, or other product does not transfer copyright or other intellectual-property rights.
Ownership of a physical fine-art work conveys ownership of that physical object only.
No Moorelight Studios photograph, artwork, text, design, or other protected material may be reproduced, copied, commercially distributed, licensed, modified, adapted, used to create derivative works, or otherwise exploited without prior written permission.
Moorelight Studios content may not be scraped, harvested, ingested into datasets, used for artificial-intelligence or machine-learning training, model development, image generation, style replication, or similar computational uses without express written authorization.
Fine-Art Purchases
Fine-art photographs offered through Convergence Fine Art / Moorelight Studios may be produced to order and may be signed, numbered, limited in edition, accompanied by a Certificate of Authenticity, or otherwise prepared specifically for the acquiring collector.
Presentation materials, dimensions, edition information, availability, production method, pricing, and other details will be identified on the applicable product page or communicated directly by Moorelight Studios.
Edition numbers are assigned and documented by Moorelight Studios. Unless expressly agreed otherwise in writing, purchase of a limited-edition work does not guarantee a particular edition number.
Moorelight Studios reserves the right to correct typographical errors, inaccurate product information, pricing errors, inventory errors, or other unintended website errors.
Orders and Order Acceptance
Submission of an order constitutes an offer to purchase the selected product under these Terms.
An automated order confirmation acknowledges that the order has been received. Moorelight Studios reserves the right to review and, where reasonably necessary, decline or cancel an order because of payment problems, suspected fraud, product unavailability, production limitations, pricing or website errors, or other legitimate fulfillment concerns.
If Moorelight Studios cancels an order after payment has been collected and before the order has been fulfilled, the applicable payment will be refunded.
Pricing and Payment
Prices are shown in U.S. dollars unless otherwise stated.
Customers are responsible for the purchase price, applicable taxes, shipping, handling, insurance, and other charges shown during checkout.
Payment is processed through third-party payment providers made available through the website, which may include WooPayments and supported card or digital-wallet services.
Moorelight Studios does not directly control the processing systems, security procedures, authorization rules, settlement schedules, or other operations of independent payment providers.
An order may not proceed into production until required payment authorization has been received.
Production and Fulfillment
Many Moorelight Studios fine-art works are created or fabricated specifically after an order is placed.
Production may include printing, mounting, finishing, fabrication, signing, numbering, inspection, preparation of provenance or Certificate of Authenticity materials, packaging, and related fulfillment work.
Production and delivery estimates are estimates rather than guaranteed dates unless Moorelight Studios expressly agrees otherwise in writing.
Once production has begun, cancellation or change-of-mind return rights may be limited as described in our Refund and Returns Policy.
Shipping and Delivery
Fine-art purchases may be shipped using professional carriers and protective packaging appropriate to the work and presentation type.
Checkout charges identified as Insured Fine Art Shipping & Handling may include shipping, specialized packaging, handling, declared-value protection or insurance, and other costs associated with safely delivering the work.
Shipping charges may vary according to presentation type, dimensions, destination, quantity, packaging requirements, and insurance or declared value.
Delivery dates provided by carriers are estimates and may be affected by weather, carrier delays, transportation disruptions, address issues, or other circumstances outside Moorelight Studios’ reasonable control.
Customers are responsible for providing a complete and accurate delivery address and for ensuring that the shipment can be safely received at that address.
Additional or alternative arrangements may be required for certain oversized works, Monumental Editions, Alaska or Hawaii shipments, international destinations, or locations requiring specialized delivery.
Shipping Damage
Please inspect artwork and its packaging as soon as reasonably possible after delivery.
Visible or suspected shipping damage should be reported to Moorelight Studios within 48 hours of delivery at hello@moorelightstudios.com.
Customers reporting shipping damage should retain the artwork, shipping container, interior packaging, labels, and protective materials and provide photographs sufficient to document the condition of the shipment and work.
Reports received after 48 hours will still be reviewed, but delay may affect our ability to document or pursue a carrier or insurance claim.
Complete procedures concerning damaged shipments are contained in the Moorelight Studios Refund and Returns Policy.
Returns, Cancellations, and Refunds
Fine-art purchases are generally final once production has begun because many works are produced specifically for the acquiring collector.
Exceptions may apply in circumstances involving shipping damage, a verified production defect, an incorrect item, or another fulfillment error attributable to Moorelight Studios or its production partners.
No artwork should be returned without prior authorization and return instructions from Moorelight Studios.
All cancellations, returns, damage claims, and refunds are governed by the current Refund and Returns Policy, which is incorporated into these Terms by reference.
Visual Representation of Artwork
Moorelight Studios makes reasonable efforts to present photographs, artwork, colors, materials, dimensions, and finishes accurately.
However, screens, browsers, devices, lighting conditions, display calibration, printing processes, substrates, acrylic, metal, paper, mounting systems, and other physical materials may cause the appearance of a finished work to differ somewhat from its on-screen representation.
Such ordinary variations do not necessarily constitute a defect.
Limited Editions and Provenance
Limited-edition works may be accompanied by edition records, provenance documentation, Certificates of Authenticity, or other collector materials.
These materials form part of the history and documentation of the physical work and should be preserved with it.
If an authorized return involves a signed or numbered limited-edition work, all accompanying Certificates of Authenticity, provenance documentation, edition records, and collector materials supplied with the work must also be returned.
Moorelight Studios maintains authority over its own edition and provenance records.
Books and Literary Works
Books, literary works, publishing products, and future merchandise may have different production, delivery, cancellation, preorder, and return terms from fine-art works.
When a particular product page or written offer provides specific terms for that product, those product-specific terms will apply together with these Terms.
Third-Party Services and Links
The Moorelight Studios website may contain links to or integrations with third-party services, including payment processors, shipping carriers, visualization tools, social networks, production partners, and other service providers.
Moorelight Studios is not responsible for the independent content, terms, privacy practices, security, availability, or operation of third-party websites or services.
Use of those services may also be subject to their own terms and policies.
Privacy
Information collected through the website is handled according to the Moorelight Studios Privacy Policy and applicable law.
By using this website or completing a transaction, you acknowledge that certain information may be transmitted to service providers where reasonably necessary to process payments, fulfill orders, deliver purchases, prevent fraud, provide customer service, or operate the website.
Disclaimer
Moorelight Studios makes reasonable efforts to maintain accurate website information and reliable services, but the website and its content are provided on an “as available” basis.
To the fullest extent permitted by applicable law, Moorelight Studios does not guarantee uninterrupted website availability or that all content will be free from technical errors, temporary interruptions, or inadvertent inaccuracies.
Nothing in these Terms excludes any warranty, right, or remedy that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Moorelight Studios, LLC will not be liable for indirect, incidental, special, punitive, or consequential damages arising solely from the use or inability to use this website.
Nothing in these Terms limits liability where such limitation is prohibited by law or eliminates rights or remedies expressly provided under applicable consumer-protection law.
Governing Law
These Terms are governed by the laws of the State of Montana and applicable federal law, without regard to conflict-of-law principles, except where another jurisdiction’s law must apply by statute.
Changes to These Terms
Moorelight Studios may revise these Terms from time to time as the studio, website, products, services, legal requirements, or business practices evolve.
The effective version will be identified by the “Last Updated” date appearing above.
Changes will apply prospectively unless applicable law requires otherwise.
